This book contains meaning, origin as well as other countries. Different subjects of Mandamus available in India during pre independence as well as the post-independence era are discussed with the help of the important case of the courts of UK, USA as well as the Supreme Court of India and selected judgments of different High Courts.
Elaborate discussion is made in the book about the widening the scope of Mandamus during the period of the years 1975 to 1974 by taking into consideration different judgments of the Supreme Court of India. It is also described how the Supreme Court of India has, by its judgments narrowed down the scope of issuance of writ of Mandamus in the year 2002 and thereafter. With the increasing trend of privatization in India, even the Government is withdrawing its hands from public sectors. In these circumstances, unless the scope of Mandamus is expanded, the protection of fundamental rights through writ of Mandamus will remain on paper only. At the end, the possible way of expansion of writ of Mandamus is suggested by taking into consideration the hurdles in doing it.
This book will be immensely helpful to the post-graduate students, academicians, researchers and practicing advocates in tracing the origin, development and comparing the earlier and recent trend of the Supreme Court and High Courts in issuing writ of Mandamus.
